HB 4797: Illinois Moves Closer to Legal Online Poker

Illinois may be on the verge of joining the digital poker revolution. Following the momentum set by Maine and Virginia earlier this year, House Bill 4797, introduced by Representative Edgar González Jr., aims to finally bring online poker and iGaming to the Land of Lincoln. While Illinois has long been a powerhouse in retail casinos and sports betting, its online poker market has remained untapped—until now.The Road to HB 4797

Illinois isn’t new to gambling expansion. Since 2019, the state has launched sports betting, installed video gaming terminals (VGTs) across bars, and begun major projects like Bally’s Chicago. But online poker and casino games have been politically sensitive, with previous bills between 2023–2025 stalling due to concerns from labor unions and regional casino operators.

Now, two key factors make HB 4797 more viable:

  1. Budget Pressure: Illinois faces a projected $2.2 billion deficit for the 2026 fiscal year.

  2. Tax Precedent: After raising sports betting taxes in 2025, lawmakers are seeking new revenue streams.

What HB 4797 Proposes

The bill is essentially a full Internet Gaming Act, legalizing online slots, table games, and, crucially, online poker. Key points include:

  • Taxes: 25% privilege tax on all adjusted gross revenue.

  • Licensing: Each licensed casino or racetrack can partner with up to three online platforms (skins).

  • Entry Fees: $250,000 initial license fee; $100,000 renewal every few years.

  • Server Location: Year one can use U.S.-based servers; after that, all servers must be physically in Illinois.

For poker players, the most exciting prospect is Illinois joining the Multi-State Internet Gaming Agreement (MSIGA). With nearly 13 million residents, Illinois could become the largest state in the compact, massively expanding the pool of online players.

The Main Obstacle

Concerns remain that online gaming could cannibalize brick-and-mortar casinos. To address this, HB 4797 includes a workforce protection clause, designed to safeguard casino jobs—a feature that has sparked debate among industry stakeholders.

If passed, HB 4797 could transform Illinois into a major online poker hub, opening opportunities for players, generating substantial tax revenue, and potentially putting the state on the national iGaming map.
